1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.2 "Customer", "you" and "your" refer to the person, business, or organisation requesting and paying for the services.

1.3 "Services" means the rubbish removal, waste collection, bulky waste clearance, or related services provided by us as agreed at the time of booking.

1.4 "Booking" means any order for Services made by you and accepted by us in accordance with these Terms and Conditions.

1.5 "Waste" means any items or materials that you ask us to collect and dispose of as part of our Services, excluding any prohibited or hazardous materials unless specifically agreed in advance.

2. Scope of Services

2.1 We provide domestic and commercial rubbish removal and waste collection services, including but not limited to household clearances, garden waste removal, office rubbish collections, and general junk removal.

2.2 The exact scope of the Services for each Booking will be based on the description of the Waste provided by you at the time of enquiry or booking, and our confirmation of what is included.

2.3 Our services generally include loading, transportation, and lawful disposal or recycling of the Waste. We reserve the right to refuse collection of items that are not as described, unsafe to handle, or prohibited by law or regulation.

2.4 We do not provide cleaning, repair, or building services as part of a standard rubbish removal appointment. Any additional work requested outside the agreed Services may be chargeable and will only be undertaken at our discretion.

3. Booking Process

3.1 You may request a Booking by telephone, email, or through any booking system we make available. All Bookings are subject to availability and confirmation by us.

3.2 When making a Booking, you must provide accurate and complete information, including the type and approximate volume or weight of Waste, access details, the collection address, and any relevant site restrictions such as parking limitations or restricted access areas.

3.3 We may provide an initial price estimate based on your description of the Waste and the location. This estimate is not binding and may be revised at the time of collection if the actual volume, weight, type of Waste, or site conditions differ from the information provided at the time of booking.

3.4 A Booking will only be confirmed once we have accepted your request and, where applicable, received any required deposit or pre-authorisation. We reserve the right to decline any Booking request at our sole discretion.

3.5 You are responsible for ensuring that an authorised person is present at the collection address at the scheduled time to grant access, confirm the Waste to be collected, and approve any revised charges if required.

4. Service Times and Access

4.1 We will use reasonable efforts to attend the collection address on the agreed date and within any time window specified. However, times are estimates only and are not guaranteed. Delays may occur due to traffic, weather, operational issues, or circumstances beyond our control.

4.2 You must ensure that we have safe and reasonable access to the Waste at the scheduled time. This includes ensuring that driveways, stairways, lifts, and access routes are clear and suitable for our team and vehicles.

4.3 If we are unable to carry out the Services due to inadequate access, unsafe conditions, incorrect address details, or your failure to be present, we may charge a missed collection or call-out fee, and any deposit paid may be retained to cover our costs.

4.4 Where parking permits, pay-and-display charges, or access fees are required to complete the collection, you are responsible for providing the necessary permits or reimbursing us for any applicable charges.

5. Pricing and Payment

5.1 Our charges are generally based on the volume, weight, and type of Waste collected, the time required, and any additional services or access difficulties. We may also consider disposal fees, recycling requirements, and any specific handling needs.

5.2 Unless otherwise agreed in writing, all prices quoted are exclusive of any parking charges, congestion charges, or other local fees, which will be added to the final invoice if incurred.

5.3 We may require a deposit, pre-payment, or card pre-authorisation at the time of Booking. The balance of any charges is payable upon completion of the collection, unless otherwise agreed in advance.

5.4 Payment can usually be made by debit card, credit card, or bank transfer. We reserve the right to refuse cash payments or to specify acceptable payment methods for operational or security reasons.

5.5 You must make full payment on the day of service, unless we have expressly agreed credit terms in advance. Where credit terms are agreed, invoices are payable within the time period shown on the invoice. Late payment may incur interest and administrative charges in accordance with applicable law.

5.6 If the actual amount or nature of Waste differs from your description, we may adjust the price accordingly. Our team will notify you of any price changes before proceeding. If you decline the revised price, we may cancel the collection and charge a reasonable call-out or cancellation fee.

6. Cancellations and Amendments

6.1 You may cancel or amend a Booking by contacting us directly. Any cancellation or amendment is only effective once we have confirmed it.

6.2 If you cancel more than 24 hours before the scheduled collection time, any deposit paid may be refunded at our discretion, less any reasonable administrative costs incurred.

6.3 If you cancel less than 24 hours before the scheduled collection time, fail to provide access, or are not present at the property at the agreed time, we may retain your deposit and/or charge a late cancellation or missed collection fee to cover our costs.

6.4 We reserve the right to cancel or reschedule a Booking at any time due to circumstances beyond our control, including but not limited to vehicle breakdown, staff illness, severe weather, or safety concerns. In such cases, we will offer an alternative appointment where possible. Our liability in such circumstances is limited to the return of any deposit paid for the affected Booking.

7. Customer Responsibilities

7.1 You are responsible for ensuring that the Waste to be collected is clearly identified and accessible at the collection address. Where you are not present, you must give clear instructions and authorisation in advance.

7.2 You must inform us in advance if the Waste includes any items that may be hazardous, sharp, heavy, or otherwise unsafe to handle, so that we can assess whether we can accept them and apply appropriate safety measures and charges.

7.3 You warrant that you either own the Waste or have the owner’s permission to dispose of it. You will indemnify us against any claim by a third party alleging that the removal of the Waste was not authorised.

7.4 You must not include in the Waste any items that are prohibited or restricted by law, including but not limited to asbestos, clinical waste, chemicals, gas bottles, explosive materials, and certain electrical items, unless we have expressly agreed in writing to handle such materials in compliance with relevant regulations.

8. Waste Regulations and Disposal

8.1 We operate in accordance with applicable UK waste management legislation and guidance, including the duty of care requirements relating to the storage, transport, and disposal of controlled waste.

8.2 We will transfer, recycle, or dispose of Waste at licensed facilities or through authorised partners wherever reasonably practicable, and may seek to maximise recycling and reuse of materials.

8.3 Where required by law or industry practice, we may issue a waste transfer note or similar documentation in relation to the Waste collected. You must retain any such documents provided to you for your records as evidence of lawful disposal.

8.4 We reserve the right to decline or cancel a collection if we reasonably believe that handling, transporting, or disposing of the Waste would breach any law or regulation or would pose an unacceptable health or safety risk.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in performing the Services. However, we shall not be liable for any loss, damage, or expense that is not directly caused by our negligence or breach of these Terms and Conditions.

9.2 You must take reasonable steps to protect your property prior to our arrival, including covering floors, removing fragile items from access routes, and advising our team about any particularly delicate or vulnerable areas.

9.3 We shall not be liable for normal wear and tear or minor cosmetic damage to floors, walls, doors, or fixtures that may occur as a result of moving bulky items through restricted spaces, provided we have exercised reasonable care.

9.4 Our total liability for any claim arising out of or in connection with the Services shall be limited to the total amount paid or payable by you for the relevant Booking, except where such limitation is not permitted by law.

9.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

9.6 We are not liable for any consequential, indirect, or economic losses, including but not limited to loss of profit, loss of business, or loss of opportunity, arising from or in connection with the Services.

10. Insurance

10.1 We maintain insurance cover that is appropriate for the nature of our operations, including public liability insurance. Details of our insurance cover are available on request.

10.2 It is your responsibility to ensure that you have adequate insurance in place for your own property and any valuable or fragile items located at the collection address.

11. Complaints

11.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible, and in any event within 48 hours of completion of the collection, providing full details of your concerns.

11.2 We will investigate any complaint and, where appropriate, may request further information or photographs. We will aim to respond within a reasonable timeframe and may, at our discretion, offer a remedy such as a partial refund or a repeat visit.

11.3 Raising a complaint does not relieve you of your obligation to pay for the Services provided, unless we agree otherwise in writing.

12. Data Protection and Privacy

12.1 We will collect and process personal data such as your name, contact details, and service information in order to manage Bookings, provide the Services, and handle payments and accounts.

12.2 We will handle your personal data in accordance with applicable data protection laws and will take reasonable steps to protect it against unauthorised access, loss, or misuse.

12.3 We may use your contact details to communicate with you about your Booking and, where permitted, to inform you of related services. You may ask us at any time not to use your details for marketing purposes.

13. Variations to These Terms

13.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your Booking will apply to that Booking.

13.2 Any variation to these Terms and Conditions requested by you will only be effective if expressly agreed by us in writing.

14. Severability

14.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed removed, and the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written confirmation or invoice issued by us, constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings, arrangements, or representations, whether oral or written.

16.2 You acknowledge that you have not relied on any statement, promise, or representation made or given by or on behalf of us that is not set out in these Terms and Conditions.
